Terms and Conditions for Notary Services

1. Service Agreement and Fees
Notary services are provided at a pre-determined fee, which is agreed upon prior to booking through either the Internet or phone communication. Customers have the discretion to accept or decline the posted fee before entering their card information. There is no obligation to purchase services.

2. Cancellation and Refund Policy
All appointments for notary services are non-refundable unless a cancellation request is submitted in writing to contact@mdgnotaryca.com at least 24 hours before the scheduled appointment time. By agreeing to these terms and conditions, you acknowledge that this agreement will be presented to your card provider in the event of a chargeback dispute. Additionally, payees agree to cover all fees associated with chargeback disputes.

3. Service Assignment and Rendering

Services will only be assigned and rendered upon the completion of prior arrangements. This stipulates that a notary will not be designated for your appointment unless payment has been received for the requested service.

4. Refund and Discount Policy

If the notary fails to arrive within one hour of the scheduled appointment time, clients are entitled to a full refund provided no services have been rendered. In cases where the notary is delayed by one hour, but services are still performed, clients may receive up to a 75% discount at the discretion of management.

5. Appointment Scheduling

All signings must be scheduled with a minimum notice of two hours. Clients should be aware that an appointment will only be considered on-time if it commences within 15 minutes of the scheduled start time. This policy also applies to signers who either refuse or are unable to sign within 15 minutes from the start of the appointment. Our mobile notaries adhere to a strict schedule to ensure timely service for all clients.

6. Signers Requirements

Signers must be coherent and willing to sign the documents. If the notary public determines that a signer is unwilling or incoherent, the notarial act will not be performed, and no refund will be issued.

7. Jail Notarizations

For notarizations conducted in correctional facilities, proper identification is required. If you do not possess valid identification (other than a state ID card), arrangements must be made for a guard or sheriff to serve as a credible witness prior to the notarization. In the absence of a credible witness, a waiting fee of $1.00 per minute will be charged.

Please note that inmates may require extended periods to be brought out for notarization. Appointments for jail notarizations are scheduled for one hour only. After the initial hour, an additional fee of $1.00 per minute will apply. Ensure you have cash or card available to receive your notarized documents.

*All individuals requesting notarial services must present valid identification. Acceptable forms of identification include:*

Government-Issued Photo ID: This includes a driver’s license, passport, or any other government-issued identification card that contains a photograph and signature.

State Identification Card: A state-issued identification card that includes a photograph and signature.

Military Identification Card: An active or retired military ID card with a photograph and signature.

Permanent Resident Card: A U.S. Permanent Resident Card (Green Card) with a photograph and signature.

Credible Witnesses: An individual who personally knows the signer and possesses one of the aforementioned types of identification. This witness must be willing to sign the notary journal on behalf of the signer and take an oath affirming the signer’s identity.

Identification Rule Exceptions

Purpose: These exceptions apply exclusively to real estate conveyance and financing transactions.

Acceptable Forms of Identification:

Foreign Passport with Visa: A valid, unexpired passport issued by a national government other than the United States, accompanied by a valid, unexpired visa or other documentation necessary to establish the individual’s legal presence in the United States.

Department of Homeland Security Approved ID: Any other valid, unexpired identification deemed acceptable by the United States Department of Homeland Security for establishing an individual’s legal presence in the United States, accompanied by any supporting documents required by the Department of Homeland Security.
